Data protection

The protection and security of personal data is of utmost importance to FKG Dentaire Sàrl (FKG). We collect and process personal data in accordance with applicable data protection laws and regulations, including the European General Data Protection Regulation (GDPR) and the Swiss Data Protection Act. References to the GDPR refer to data processing operations subject to the GDPR.

In this privacy policy, we inform you which personal data we process when you visit our website and make use of our offers and services and which rights you have. We therefore ask you to read the following information carefully.

Personal data is any information relating to an identified or identifiable natural person. This includes, for example, your name, your address and communication data or your e-mail address.

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Data subject is any identified or identifiable natural person whose personal data is processed by the controller responsible for the processing.

Controller or controller responsible for the processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

Users include all categories of data subjects affected by data processing. These include our business partners and other visitors to our website.

With regard to the terms used within the scope of the GDPR, we also refer to the definitions in Art. 4 GDPR. The terms used, such as “user”, are to be understood as gender-neutral.

3. Processing of personal data

3.1 Visiting our website

3.1.1 Scope of data processing

When you visit our website, your browser transmits certain data to our web server for technical reasons. This involves the following data (so-called server log files):

Date and time of the request

Time zone difference to Greenwich Mean Time (GMT)

Content of the request (specific page)

Operating system and its access status / HTTP status code

Amount of data transferred

Website from which the request originates (“referrer URL”)

Browser, language and version of the browser software

3.1.2 Purpose of data processing

The storage of this data in log files is necessary to ensure the functionality of the website. They help us to optimize the website and to ensure the security of our information technology systems.

3.1.3 Legal basis for processing

We collect this data on the basis of our legitimate interest within the meaning of Art. 6 para. 1 lit. f) GDPR in order to be able to display our website and ensure its security.

3.1.4 Duration of storage

Information in the log files is stored for a maximum of seven days for security reasons (e.g. to clarify acts of abuse or fraud) and then deleted. Data whose further storage is required for evidentiary purposes is excluded from deletion until the respective incident has been finally clarified.

3.1.5 Possibility of objection and removal

The collection of data for the provision of the website and its storage in log files is absolutely necessary for operation for technical reasons. Consequently, the user has no option to object.

 

3.2 E-mail contact

3.2.1 Scope of data processing

It is possible to contact us via the e-mail addresses provided by us – depending on the request. In these cases, the sender’s personal data transmitted with the email will be processed. The data is used exclusively for processing the conversation, for processing the request or as part of participation in the corresponding FKG marketing campaign.

3.2.2 Purpose of data processing

The processing of personal data serves us to process the contact. The other personal data processed during the sending process (e.g. date, time) is used to prevent misuse and to ensure the security of our information technology systems.

3.2.3 Legal basis for processing

When contacting us by e-mail, the user’s details are processed to process the contact request and its handling in accordance with Art. 6 para. 1 lit. b) GDPR: This also constitutes the necessary legitimate interest in processing the data.

3.2.4 Recipients of the processing

If you contact us by e-mail, your personal data will be processed by the internal departments responsible for the respective matter.

3.2.5 Duration of storage

The data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations (e.g. for commercial and tax law reasons).

3.2.6 Objection and removal options

You have the option of withdrawing your consent to the processing of personal data at any time. If you contact us by e-mail, you can object to the storage of your personal data at any time. In this case, our conversation can no longer be continued. If you contact us by email, please send such a revocation to the email address info@fkg.ch. All personal data stored in the course of contacting us will then be deleted.

 

3.3 Applications

3.3.1 Scope of data processing

If you are interested in working for our company, you can apply to us online. Under the menu item “Careers” you will find jobs that we have advertised. You can also send us an unsolicited application.

3.3.2 Application form

If you apply to us via the application form, we will process the data that you have entered in the input mask. The data types marked with * are mandatory fields.

3.3.3 Purpose of data processing

We process personal data in particular for the selection process of suitable candidates and the administrative implementation of the application procedure in order to be able to make a decision on the establishment of an employment relationship.

3.3.4 Legal basis for processing

The legal basis for the processing of applicants’ data is Art. 6 para. 1 lit. b. GDPR.

 

3.4 Recipients or categories of recipients of the personal data

Your personal data is processed exclusively by internal departments (personnel, supervisor of the position, management). It is not transferred to third parties, with the exception of our service providers as part of data processing. There is no intention to transfer personal data to a third country or an international organization.

3.4.1 Duration of storage

If the application leads to an employment relationship, we will process your data for the duration of the employment relationship. The data will then be included in our personnel management system. If the application does not lead to an employment relationship, your data will be deleted unless you have given us your consent in accordance with Art. 6 para. 1 lit. a) GDPR and Art. 7 GDPR to store your personal data for a longer period of time in order to be considered for new job offers.

3.4.2 Possibility of objection and removal

You can have the information you have transmitted to us deleted or renewed at any time on request. To do so, please send us an e-mail to info@fkg.ch.

 

3.5 Cookies

3.5.1 Scope of data processing

Our website uses cookies. Cookies are small text files that are stored on your computer when you visit our website. Cookies do not cause any damage to your computer and do not contain any malware such as viruses. Cookies contain a characteristic string of characters that enables the browser to be uniquely identified when the website is called up again. Some elements of our website require that the accessing browser can be identified even after a page change.

This is not done by assigning the cookie to you personally, but by assigning an identification number to the cookie (“cookie ID”). The cookie ID is not merged with your name, IP address or similar data that would allow the cookie to be assigned to you.

This website uses transient and persistent cookies.

a) Transient cookies are automatically deleted when you close the browser. These include session cookies in particular. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. When you return to our website, your computer can be recognized. The session cookies are deleted when you log out or close the browser.

b) Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete the cookies at any time in the security settings of your browser.

3.5.2 Purpose of data processing

We use cookies to make our website attractive and user-friendly, to improve it and to speed up inquiries. Some elements of our website require that the accessing browser can be identified and recognized even after a page change.

3.5.3 Legal basis for data processing

The legal basis for the processing of personal data using technically necessary cookies is the protection of legitimate interests in accordance with Art. 6 para. 1 lit. f) GDPR.

3.5.4 Duration of storage

Transient/session cookies are deleted as soon as the browser is closed.

Persistent cookies are automatically deleted after a specified period.

3.5.5 Objection and removal options

As a user, you have full control over the use of cookies. By changing the settings in your Internet browser, you can set it so that cookies are not stored at all or are automatically deleted at the end of your Internet session. To do this, select “Do not accept cookies” in your browser settings. In Microsoft Edge, select “Settings > Cookies and website permissions > Manage and delete cookies and website data”; in Google Chrome, select “Settings > Privacy and security”. If you use a different Internet browser, please refer to the browser’s help function for instructions on preventing and deleting cookies. Please note, however, that in this case you may not be able to use all the functions of our website.

 

3.6 Web analysis

3.6.1 Scope of data processing

We use Google Analytics 4.0 on our website, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”).

Google analyzes your use of our website on our behalf. We use cookies for this purpose, among other things. We have described what cookies are and how they can be deleted in the “Cookies” section above. The information collected by Google about your use of this website (e.g. the pages you visit on our website) is transferred to a Google server in the USA, stored there, analyzed and the result made available to us in anonymized form.

We use the IP anonymization offered by Google on our website. This means that your IP address will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Google is certified in the EU-US Data Privacy Framework, which guarantees an appropriate level of data protection for data at Google in the USA.

3.6.2 Purpose of data processing

On our behalf, Google uses this information to evaluate the use of our website and to compile reports on the activities within our website. This enables us to improve your online experience and increase the user-friendliness of our website.

3.6.3 Legal basis of the processing

The legal basis is Art. 6 para. 1 lit. a) GDPR.

3.6.4 Duration of storage

Sessions are ended after a certain period of time. By default, sessions are terminated after 30 minutes without activity. The maximum time limit for cookies is two years.

3.6.5 Objection and removal options

The IP address transmitted by your browser will not be merged with other Google data. You can prevent the storage of cookies by setting your browser software

accordingly, as described above in the “Cookies” section. You can also prevent Google from collecting the data generated by the cookie and relating to your use of our website and from processing this data by Google by downloading and installing the available browser plug-in from Google: https://tools.google.com/dlpage/gaoptout?hl=de.

If you wish to prevent the future collection of your data by Google Analytics when visiting our website via various devices (especially mobile devices such as smartphones or tablets), you must opt out on all systems used.

4. Data security

We take technical, contractual and organizational measures for the security of data processing in accordance with the state of the art. In this way, we ensure that the provisions of the data protection laws, in particular the GDPR, are complied with and that the data processed by us is protected against destruction, loss, alteration and unauthorized access. These security measures also include the encrypted transmission of data between your browser and our servers. Please note that SSL encryption is only activated for transmissions over the Internet if the key symbol appears in the bottom menu bar of your browser window and the address begins with https://. SSL (Secure Socket Layer) uses encryption technology to protect data transmission against illegal access by third parties. If this option is not available, you can also decide not to send certain data via the Internet.

 

5. Disclosure of data to third parties

Data will only be passed on to third parties within the framework of legal requirements. We only pass on user data to third parties if this is necessary, for example, on the basis of Art. 6 para. 1 lit. b) GDPR for contractual purposes, if we are legally obliged to do so (Art. 6 para. 1 lit. c) GDPR) or on the basis of legitimate interests pursuant to Art. 6 para. 1 lit. f) GDPR in the economic and effective operation of our business operations.

We use subcontractors for the provision of our services, in particular for the operation, maintenance and hosting of the website and our information technology systems, as part of data processing in accordance with Art. 28 GDPR. We have taken appropriate legal precautions and appropriate technical and organizational measures to ensure the protection of personal data in accordance with the relevant legal regulations.

 

6. Data transmission abroad

Any personal data that you provide to us when using this website may be transferred to and stored in geographic regions where different and less stringent data protection regulations apply than in your own country of residence. Such transfers will be made in compliance with applicable law.

If your personal data is covered by the GDPR, FKG concludes contracts for the transfer of personal data to affiliated companies in third countries outside the European Union, the European Economic Area or in the absence of an adequacy decision, which contain the EU standard contractual clauses that constitute appropriate and suitable safeguards to ensure compliance with the GDPR in accordance with the decisions of the EU Commission of June 4, 2021 (EU 2021/914).

 

7. External services and content on our website

We integrate external services or content on our website. This is done on the basis of our legitimate interests in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f) GDPR.

When using such a service or displaying third-party content, communication data such as date, time and IP address are exchanged between you and the respective provider for technical reasons. In particular, this involves your IP address, which is required for the display of content in your browser.

It is possible that the provider of the respective services may process the content of your data for other purposes of their own. However, as we have no influence on the data collected by third parties and its processing by them, we cannot provide any binding information on the purpose and scope of the processing of your data. 8. Social media

8.1 Social media plugins

We currently use the following social media plugins: Facebook, Google Maps, YouTube, LinkedIn and Instagram. When you visit our website, no personal data is passed on to the providers of the plugins. The provider of the social media plugin can be recognized by the respective logo. We give you the option of communicating directly with the provider of the plugin via the button. These plugins collect data from you by default and transmit it to the servers of the respective provider. When you access a page on which the social media plugins are integrated, they are initially deactivated. Only by clicking on the respective symbol/logo of the provider will the corresponding plugin be activated and you thereby give your consent for your data to be transferred to the respective provider and stored accordingly (in the case of US providers in the USA). If you are a member of one of the listed social networks and are logged in to the social network during your visit to our website, your data and information about your visit to this website can be linked to your profile on the social network after clicking on the respective logo of the social media provider.

Since the plug-in provider collects data in particular via cookies, we recommend that if you do not wish to transmit information to the social media provider, you log out of the respective social network before activating the social media button and delete all cookies via your browser’s security settings. We have no influence on the data collected and data processing procedures, nor are we aware of the full extent of data collection, the purposes of processing or the storage periods of the social media plug-in providers. We also have no information on the deletion of the data collected by the plug-in provider.
